TERMS AND CONDITIONS

By purchasing tickets to or attending events (collectively, “Event”) hosted by WR Sport Horse, Inc., d/b/a Sunset Polo or Sunset Polo at Great Meadow (“Host”), at Great Meadow Foundation (“GMF”), the consideration for which is hereby acknowledged to be received and sufficient, you (“you”) on behalf of yourself, any minor child, or any other individual with a disability who is unable to agree to these Terms and Conditions (collectively, “your parties”), agree to abide by the following Terms of Conditions:

General Admission Tickets. Each general admission ticket (“GA Ticket”) purchased is valid from May 24, 2025 to September 13, 2025 (“Season”) for one Saturday Event. Each GA Ticket is also valid for the admission of one vehicle with up to five individuals within the vehicle. Each additional individual (no matter the age) in the vehicle will be charged Ten Dollars ($10) as an additional entry fee. Additional tickets may be purchased by calling 540-252-6951. Each vehicle on the GMF property (“Venue”) must possess an official general admission pass. No other form of ticket or pass will be acceptable to gain access to the Venue and the Event. In the event you reserve a box, tailgate, entertainment deck or pavilion rental to host an event and will distribute tickets to your guests for your specific event, you agree that each of your guests will also be required to purchase or obtain a GA Ticket. A GA Ticket or a ticket for a box, tailgate, entertainment deck or pavilion rental shall be collectively referred to herein as “Tickets”.

Cancellation and Refundability. ALL TICKET PURCHASES (INCLUDING SERVICE FEES) ARE FINAL AND NON-REFUNDABLE. In the event of cancellation for inclement weather or other Acts of God before the gates open, GA Tickets may be used on any Saturday night during the Season. In the event of a cancellation of the Event after the gates open, any GA Tickets used during the cancelled Event shall be deemed “used” and you will be required to purchase a new GA Ticket for any future event. In the event you have reserved a box, tailgate, entertainment deck or pavilion rental and the Event is cancelled before the gates open, Host will reassign your reserved space for the rain-out date, or an earlier date if available. Host reserves the right to postpone or cancel Events for any reason. You should always check that an Event is actually occurring on any particular Saturday before arriving at the Venue.

Food and Beverage. You may bring outside food and certain beverages (see Section 4 below) into the Venue and food may be purchased at the Venue. In the event you wish to host a catered event at the Venue, upon request, Host will provide names of approved caterers for your event. Additional GA Tickets shall be required to be purchased (if available) for any caterer or service personnel. You must provide your own tableware, water, ice and non-alcoholic beverages. WOOD, GAS OR COAL BURNING STOVES, BARBECUES, AND GROUND FIRES ARE NOT PERMITTED. Due to ABC regulations, you must be 21 years of age, with a valid ID, to purchase or consume alcoholic beverages. Wine and beer will be available for purchase from other vendors at the Venue.

Glass. Only shatterproof glass containers may be brought into the Venue at any time. Wine bottles and liquor bottles are permissible, but all other glass bottles are strictly prohibited at the Venue and are subject to confiscation. For a violation of this Condition, in the sole discretion of Host, you may be subject to a fine (a minimum of $500), revocation of your purchased Tickets, and/or revocation of your right to purchase future Tickets.

Removal of Trash. All trash brought by you, or the trash byproducts of any items purchased at the Venue, must be left bagged, placed in the designated trash receptacles, or removed with you upon departure from the Venue For a violation of this Condition, in the sole discretion of Host, you may be subject to a fine (a minimum of $500), revocation of your purchased Ticket, and/or revocation of your right to purchase Tickets.

Personal Conduct. You understand that many of these Terms and Conditions are in place for the protection of the health and safety of you, other guests, Host’s and Venue’s employees, agents, riders and the equine. Skates, skateboards, scooters, and bicycles are prohibited at the Venue. You agree that neither you nor any of your parties will sit or stand on the railings of the Venue. You further understand that these are family-oriented Events, and any conduct of you or any other individual with you infringing upon neighboring spaces or the rights of others is prohibited. Drunk or disorderly conduct is subject to arrest and removal from the Event and potentially banning you from future Events. You accept responsibility for the conduct of all people in your party and any other person you elect to associate with at the Venue. Further, should any violation of you result in the loss of Host being entitled, able or permitted to host additional Events at the Venue, you agree to be liable for all costs, expenses and losses associated with said loss, including but not limited to, all direct, indirect, vicarious, consequential, exemplary, incidental, special or punitive damages, including lost profits. Host reserves the right to report to law enforcement authorities or other relevant third-parties any activity that Host believes, in its sole discretion, may in any way violate any local, state, federal or international law.

Animals. No animals, except service/dog animals or animals utilized in law enforcement are permitted at the Venue.

Engaging with Equine. You are prohibited from engaging with any equine at the Venue, including but not limited to the trailer parking lot, unless a rider and his or her equine initiates the engagement. Any engagement with an equine shall be at you and your parties’ sole risk and Host and GMF assume no liability with respect to any personal injury or death to you or your parties or damage or destruction to any of your or your parties’ personal property.

Music and Generators. No personal music may be played so that it is audible to any other individual while in the Venue. Generators are strictly prohibited.

Personal Tents, Canopies, and Sun Umbrellas. Personal tents, canopies and sun umbrellas are prohibited in the Venue.

Security. You understand and agree that Host and GMF do not provide any security at the Venue and/or during the Event. You assume at your own risk the loss and/or damage of any personal property you bring with you to the Venue and the Event, including but not limited to your vehicle.

Vehicles. All vehicles must be parked in their designated lot or parking spaces. Driving on Stadium Hill or the general admission seating area is strictly prohibited.

Signage and Promotions. In the event you reserved a box, tailgate, entertainment deck or pavilion rental, your reserved space will be identified by a standard sign provided by Host with your name located in front of the space. Flags, balloons, signage, streamers or other promotional materials may not be placed outside your space, nor any banner placed on the Venue’s perimeter fence. Public solicitation, leafleting, posters for any cause, and political activities outside of your space are prohibited. Host reserves the right to require you to take down and/or remove any decoration, signage or other items in its sole discretion.

Advance Set Up/Arrival Time. In the event you reserved a box, tailgate, entertainment deck or pavilion rental, your reserved space will be available for you to prepare it for your event by 5:00 PM on an Event day. All vehicles must be relocated to the general parking area no later than 5:30 PM on an Event day.

Departure Time. You agree to clean up and relocate all personal property and equipment to your vehicle no later than 10:30 PM on an Event day and to depart from the Venue no later than 10:45 PM on an Event day. Venue’s and Host’s chairs, tables and other property are not permitted to be removed from the Venue. Host reserves the right to end the event, require you and your parties to depart, and close the Venue gates before 10:45 PM on an Event day for any reason.

Intrinsic Danger. NOTICE: By purchasing this Ticket and participating in the Event, you on behalf of yourself and your parties, understand the intrinsic danger of the Event and Equine activities, AND WAIVE any claims AGAINST HOST AND GMF PURSUANT TO SECTION 19 BELOW. “Intrinsic dangers of equine activities" means those dangers or conditions that are an integral part of equine activities and the Event, including: (i) the propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them; (ii) the unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals, including but not limited to getting bit, kicked, stepped on by the equine; (iii) certain hazards such as surface and subsurface conditions, including but not limited to unlevel ground due to the equine trailers and large vehicles and the Venue’s grassy fields and other areas; (iv) collisions with other animals or objects; (v) the risk that you or another member of your party may be hit by flying objects, such as polo balls; and (vi) the potential of you or another participant at the Event acting in a negligent manner that may contribute to injury to you or other Event participants.

Minor Release. You agree on behalf of yourself and any of your parties (including minors), to release Host and all Host Parties (as defined below) from any injury or damage caused by you or your parties’ participation in a tug-of-war game.

Limitation of Liability. You hereby release Host and GMF, their employees, staff, agents, riders, members, shareholders, directors, officers, trustees, affiliates and subsidiaries, as well as any adjacent landowners to the Venue (collectively, “Host Parties”) from any liability for personal injury, death, damage or loss of personal property. You further agree that neither Host nor any Host Parties shall be liable to you or any of your parties for any property damage or an injury to or death of you or any of your parties, except in the event Host intentionally injures you or your parties or Host knowingly provides faulty equipment or tack and such equipment or tack was faulty to the extent that it did cause the injury or death of you or your parties. You, on behalf of yourself and your parties, hereby expressly assume the risk of participating in the Event, accessing and being at the Venue, purchasing any food or beverage at the Venue, interacting with any other vendor or individual at the Venue, and any act or omission constituting negligence of Host or GMF and release Host and any Host Parties from any liability or damage. In the event of injury, sickness or death caused by any food or beverage purchased at the Venue, you agree to file a claim directly against the vendor who sold you or your parties such food or beverage, and not Host or GMF. You further acknowledge the maximum liability of Host or any Host Parties, and your sole and exclusive remedy for all damages and losses suffered by you and any of your parties, causes of action, whether in contract, tort (including, without limitation, negligence) or otherwise, shall be there greater of (a) the total amount paid by you to Host, if any, over the past twelve (12) calendar months, or (b) Two Hundred Dollars ($200).

Wavier of Action. You, on behalf of yourself and your parties, by purchasing this Ticket and attending and participating in the Event at the Venue, hereby waive the right to maintain an action against or recover from Host or any Host Parties for an injury to or the death of you or any of your parties engaged in an equine activity. This waiver is valid and shall remain valid unless expressly revoked in writing by you or the parent or guardian of any of your parties who is a minor. For purposes of this section, in the case of a minor participant, the execution of a waiver by a duly authorized representative of the parent or guardian designated in writing by the parent or guardian shall constitute a valid and knowing execution of a waiver by the parent or guardian.

Indemnification. You agree to indemnify, defend and hold Host and each of the Host Parties (“Indemnified Parties”) harmless from and against any and all claims, damages, losses, and costs (including attorneys’ fees and expenses) that arise directly or indirectly out of or from: (a) your or your parties breach of these Terms and Conditions, and (b) any claim brought by a third-party against the Indemnified Parties with respect to your or your parties breach of these Terms and Conditions.

Violation of any Terms and Conditions. You understand and agree that if you or any of your parties violate any of the above Terms and Conditions, such violation may result in Host removing you from the Venue, the loss of any remaining Tickets or season passes purchased by you, a non-renewal of your season passes, fines, or other actions permitted by applicable law.

Arbitration. You agree that any and all dispute, controversy or claim arising out of or relating to (i) these Terms and Conditions, (ii) any Tickets or other items sold or purchased from Host or at the Venue, or (iii) your attendance and participation at the Event, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Washington, D.C. before one (1) arbitrator. The arbitration shall be administered by JAMS pursuant to the JAMS’ Streamlined Arbitration Rules and Procedures. The language to be used in all proceedings will be English. The arbitrator may grant any relief that could be granted by a court in the venue of arbitration, but will have no power to grant any other relief. Judgment on the award may be entered in any court having jurisdiction. In all events, the arbitrator shall have no authority or jurisdiction to hear any claim, conduct any proceeding, or grant any remedy on a class, collective or representative basis. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

Governing Law. These Terms and Conditions shall be governed by the laws of the Commonwealth of Virginia, without reference to any conflict of law principles.

Attorneys’ Fees. In the event Host must seek to enforce its rights hereunder, you agree to reimburse Host for its attorneys’ fees and expenses incurred with such enforcement.

Severability. If any provision of these Terms and Conditions is held invalid or unenforceable under any circumstance, its application in any other circumstances and the remaining provisions shall not be affected. Further the provision that has been deemed to be invalid or ineffective shall be enforced to the greatest extent by law.
